Privacy Policy

1. Our commitment

Special Needs Advocacy LLCoperates the TrustFlow platform (“TrustFlow,” “we,” “us”) to help professional trustees administer Special Needs Trusts. We understand that the information in our care — including disability, financial, and government-benefit details — is among the most sensitive a person can entrust to anyone. Protecting it is a core fiduciary and ethical duty, not an afterthought.

We never sell your information. We never share it for advertising or marketing. We never trade, rent, or otherwise monetize it with third parties.

2. Information we collect

We collect only the information necessary to administer trusts and operate the platform, which may include:
  • Beneficiary information (name, date of birth, state of residence, disability type, and government benefits enrollment such as SSI, Medicaid, Section 8, or SNAP);
  • Trust information (trust type, corpus, distributions, transactions, and accounting records);
  • Account information for trustees, staff, families, and referring professionals (name, email, role);
  • Distribution requests and supporting details you submit;
  • Limited technical data needed to keep the service secure and reliable (such as log-in activity).

3. How we use information

We use information solely to provide and improve the trust-administration services you engage us for: processing distribution requests, performing automated benefit-compliance screening, maintaining trust accounting and reporting, managing referral relationships, and securing your account. We do not use your information for advertising, and we do not build or sell profiles of any individual.

4. Who can see what

Access is restricted by role and enforced at the database level:
  • Trustees and authorized staff access the trusts they administer.
  • Families and beneficiaries see only their own trust — never another beneficiary’s data.
  • Referring attorneys and planners see only limited status and milestone information for the clients they referred. Corpus balances, benefit details, and financial records are never shared with them.

5. Service providers

To operate TrustFlow we rely on a small number of trusted infrastructure providers — for example, secure cloud database and application hosting. These providers process data only on our behalf, only as needed to run the platform, and are bound by confidentiality and data-protection obligations. They are not permitted to use your information for their own purposes, and we do not authorize them to sell or share it.

6. Legal disclosures

We may disclose information only when we are legally required to do so — for example, in response to a valid court order, subpoena, or other lawful demand, or where disclosure is necessary to comply with a trustee’s legal or court-supervised accounting obligations. Where permitted by law, we will limit such disclosures to what is required.

7. How we protect information

We protect information using industry-standard safeguards, including encrypted connections, role-based access controls enforced at the database level, and authentication for every user. No system is perfectly secure, but we take the confidentiality of trust and beneficiary data seriously and work to protect it accordingly.

8. Data retention

We retain trust and accounting records for as long as needed to administer the trust and to meet the legal, tax, and court-reporting obligations that apply to trustees, after which information is securely deleted or archived in accordance with applicable law.

9. Your rights

You may request access to, correction of, or a copy of the personal information we hold about you, subject to the trustee’s legal recordkeeping duties. Families and beneficiaries who have questions about their information should contact their trustee, or reach us directly using the details below.

10. Changes to this policy

We may update this policy as our services or legal obligations evolve. When we make material changes, we will revise the effective date above and, where appropriate, notify account holders.
